A fenntarthatóság napjainkban új paradigmaként jelenik meg a jogtudományban is. A gazdasági, környezeti, és társadalmi fenntarthatóság mellett a jog fenntarthatóságáról, és a fenntarthatósági jogról is szükséges gondolkodni. A jog és a fenntarthatóság kapcsolata nem érthető meg a házasság, a család, a magántulajdon, az állam kialakulása, kezdetei, szerepük ismerete nélkül. Az állam a nemzetségekké vált családokra épült. A család kiemelkedő szerepet töltött be a tulajdoni viszonyok területén a társadalom és a gazdasági rendszer alapegységeként. Az állammá alakulás döntő motívuma a tulajdon védelme volt. A tulajdon védelmét a család, mint közösség gyakorolta. Az állam összetartó ereje a tulajdon. Ma a házasság, a család, a magántulajdon, az állam jogintézménye egyaránt politikai támadás alatt áll. The decisive motive for becoming a state was the protection of property. The protection of property was exercised by the family as a community. Property is the unifying force of the state. Today, marriage, the family, private property, and the legal institution of the state are all under political attack. Their fate cannot be indifferent to anyone
