The doctoral dissertation concerns itself with the so-called Investor-State Dispute Settlement (ISDS) system, examining two research questions: how well-founded are the criticisms levelled against the ISDS system, and what alternatives can be found instead of ISDS. Over the course of the dissertation, the author examines the historical background of ISDS, before moving onto its characteristics both from a general and a specific viewpoint. Afterwards, the author categorizes and identifies the various criticisms facing ISDS, paying special attention to the so-called regulatory chill. The author examines and critically evaluates seventeen ISDS cases. Finally, the dissertation concludes with a statistical analysis of ISDS and an in-depth overview of the most feasible alternative to ISDS, the Investment Court System. In its conclusions, the author uses the accumulated theoretical and practical information to answer the two research questions.
