In November 1613 the diet of Transylvania adopted a very important – in some way very radical – resolution concerning the deposition of the future rulers, when they violate the conditions of the election and their oath. In fact, the control of the princely power and the right of resistance of the orders were secured in the decision, which also involves the dismissal of the prince who violated the constitutional pact. Th e novelty of this provision is that it makes an attempt to put in a kind of processualis order the control of the princely power. This was caused by the fact that both prince Sigismund Báthory and Gabriel Báthory accused of infidelity all those who disagreed with their princely politics, particularly with their foreign orientation. The property of the infi dels was confiscated, and they were in luck, if they were not executed or had the chance to escape in time, as Bethlen did. The radical nature of the diet resolution can be observed through the fact that in such express terms it was not included into the large law collection called the Approbata Constitutiones. Despite this emphatically indicates the direction of the Transylvanian public development, that the princely power may only be exercised in addition to legal constraints and controls. It is the question of the prevailing political practice and of the political forces to what extent could exercise this privilege those in charge with control against a prince full of character. In this context must be therefore interpreted the election of Gabriel Bethlen as Prince of Transylvania.
