In our study, we examine the current recommendations of the French data protection authority (CNIL) regarding the use of artificial intelligence (AI) to address the implications for children’s data protection. Since the GDPR came into effect, its activities, which specifically target raising data protection awareness among minors and data controllers, have served as a model. The EU’s data protection regulation, the GDPR, provides children with special protection, as they are less able to recognize the risks associated with data processing. This protection is further specified in the CNIL’s recommendations, which provide practical guidance to developers and operators of AI systems. These include, for example, clarifying the role of parental consent, providing children with understandable information, strengthening digital awareness, and implementing technical solutions such as data protection by design and strict data processing settings by default. It is of particular importance that children are not merely passive subjects of data processing but must gradually become capable of exercising their own rights. The second part of the paper focuses on the data protection compliance of AI system development, involving the EU AI Act into the scope of the analysis. It is emphasized here that the purpose of data processing must be clearly defined as early as the design phase, the data used must be limited to what is necessary, and an appropriate legal basis must be selected. Practices such as web scraping or the use of large datasets are acceptable only under strict conditions, particularly when children’s data is involved. Overall, AI cannot be considered either a “friend” or an “enemy.” The crucial factor is the way it is used: with appropriate data protection and security safeguards in place, AI can become an effective and useful tool even for children; without them, however, it poses serious risks. The future therefore depends on the extent to which developers are able to incorporate the protective measures recommended in the study already during the design phase.
